These terms and conditions of use ("Terms") govern the use of the website truetrace.one, applications, GPS tracking devices, and all related services (collectively, the "Services") offered by TrueTrace ("we," "our," "us").
By accessing or using our Services, you (the "User") agree to be bound by these Terms. If you do not agree with these Terms, please immediately stop using our Services.
2. Description of Services
TrueTrace offers a real-time GPS tracking platform that includes:
- The sale of GPS tracking devices (OBD2 and portable trackers) and accessories.
- An online dashboard for real-time tracking, trip history, and alert management.
- Monthly subscriptions for device activation and connectivity.
- Technical support services by email and phone.
3. Account Creation
- You must create an account to access certain features of the Services.
- You are responsible for maintaining the confidentiality of your login credentials.
- You agree to provide accurate, complete, and up-to-date information.
- You must notify us immediately of any unauthorized use of your account.
- We reserve the right to suspend or close an account in the event of a violation of these Terms.
4. Orders and Payment
4.1 Pricing and Availability
- All displayed prices are in Canadian dollars (CAD) and do not include applicable taxes (GST/QST).
- We reserve the right to change prices at any time without notice. Price changes do not affect orders that have already been confirmed.
- Product availability is subject to change without notice.
4.2 Payment
- Payments are securely processed by Moneris. We do not have access to your credit card data.
- Orders are confirmed only upon receipt of full payment.
- In the event of a payment failure, the order will be automatically cancelled.
4.3 Monthly Subscriptions
- The use of GPS tracking devices requires an active monthly subscription.
- Subscriptions are billed monthly with no long-term commitment.
- You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
- In the event of non-payment, tracking services will be suspended until payment is restored.
5. Shipping
- Shipping is free for all orders within Canada that exceed the displayed free shipping threshold.
- Orders placed before 2:00 PM (ET) are shipped the same day (business days).
- Estimated delivery time is 2 to 5 business days depending on the destination.
- A tracking number is sent by email as soon as the order is shipped.
- TrueTrace is not responsible for delays caused by the carrier or postal services.
6. Return and Refund Policy
- You have 30 days from the date of receipt to return a product.
- The product must be returned in its original packaging, in good condition, and with all included accessories.
- A full refund will be issued to the original payment method within 10 business days of receiving the return.
- Return shipping costs are the responsibility of the customer, except in the case of a defective product or an error on our part.
- Monthly subscriptions that have already been billed are non-refundable.
7. Warranty
- OBD-Pro and Portable-X trackers: 2-year limited warranty against manufacturing defects.
- OBD-Lite and Mini trackers: 1-year limited warranty against manufacturing defects.
- Accessories: 6-month limited warranty.
- The warranty does not cover damage caused by misuse, unauthorized modification, accident, water (except for devices certified IP65/IP67), or normal wear and tear.

8. Acceptable Use
You agree to use our Services in a lawful and responsible manner. The following are strictly prohibited:
- Using our devices to track a person without their explicit consent, except in cases permitted by law (e.g., a parent or legal guardian tracking a minor child).
- Using our Services for illegal purposes, including harassment, unauthorized surveillance, or any criminal activity.
- Attempting to gain unauthorized access to our systems, servers, or other users' data.
- Modifying, decompiling, or reverse-engineering our devices or software.
- Reselling our Services or data without prior written authorization.
- Using our APIs in an abusive or excessive manner that could impair the quality of service.
9. Intellectual Property
All content within our Services — including, but not limited to, the website, logos, the TrueTrace brand, software, firmware, text, images, and design — is the exclusive property of TrueTrace and is protected by Canadian and international intellectual property laws.
No license or intellectual property rights are transferred to you through the use of our Services, except for a personal, non-exclusive, and non-transferable right of use for the duration of your subscription.
10. Limitation of Liability
- Our Services are provided "as is" and "as available," without warranties of any kind, whether express or implied.
- We do not guarantee that the GPS tracking service will be uninterrupted, error-free, or free of defects.
- TrueTrace shall not be held liable for any losses, damages, or harm resulting from the use of or inability to use our Services, including, but not limited to: data loss, vehicle theft, indirect or consequential damages.
- GPS positioning accuracy depends on external factors (atmospheric conditions, physical obstructions, interference) over which we have no control.
- Our total liability, regardless of the cause, shall in no event exceed the total amount you have paid us during the preceding 12 months.
11. Indemnification
You agree to indemnify, defend, and hold harmless TrueTrace, its officers, employees, and partners from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from your use of the Services or any violation of these Terms.
12. Termination
- You may close your account at any time by contacting us at info@truetrace.one.
- We reserve the right to suspend or terminate your access to the Services in the event of a violation of these Terms, without notice or refund.
- Upon termination, your tracking data will be deleted in accordance with our Privacy Policy.
13. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the Province of Quebec and the federal laws of Canada applicable therein. Any dispute arising from these Terms shall be submitted to the exclusive jurisdiction of the courts of the Province of Quebec, District of Montreal.
14. Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced by a valid provision that most closely reflects the original intent.
15. Amendments to the Terms
We reserve the right to amend these Terms at any time. Amendments shall take effect upon their publication on our website. In the event of a substantial amendment, we will notify you by email at least 30 days before the amendment takes effect. Your continued use of the Services after the publication of amendments constitutes your acceptance of the new Terms.
